Banks could be held responsible for defrauded customers, warns Haryana top cop

GURGAON: Banks could be held responsible for the financial losses incurred by victims of cyber fraud if investigations uncover a failure to exercise “due diligence” on their part, Haryana DGP OP Singh said on Monday, underlining the importance of an institutional mechanism that proactively thwarts cyber frauds, and does not move only reactively when a customer complains. Singh said the IT Act clearly stipulates that banks are responsible for compensating victims in cases of negligence. “If a bank fails to take appropriate measures to prevent fraud or overlooks suspicious transactions, resulting in losses, it must compensate the customer. Our investigation will determine whether the bank adhered to due processes in handling the defrauded amount,” he said. The DGP’s remarks came during a surprise visit to Cyber East police station. Banks can be held liable if they do not act promptly upon being informed of a fraud, Singh stated, laying out measures to expedite release of small amounts of money frozen during cybercrime investigations. He further said victims often incur huge fees to recover even modest sums, causing undue hardship. Citing a high court directive, Singh said police could take such cases directly to Lok Adalats without registering an FIR, facilitating quicker resolution and refunds. “If a victim’s Rs 4,000 is frozen, they shouldn’t have to struggle for months. Such cases can be presented before Lok Adalat for immediate relief,” Singh added. The DGP said police will launch an expanded awareness campaign, incorporating social media outreach and community programmess. As part of this initiative, head boys and head girls in schools and colleges will be appointed as cyber awareness ambassadors to educate students about online safety and emerging fraud trends. “A dedicated network will also be established with the help of head boys and girls and SPIC MACAY to raise awareness about cybercrime and drugs through these enthusiastic Gen Alpha kids via events,” Singh later shared on social media.

Singh cautioned the public that most cybercrimes exploit greed and fear. “Anyone offering unrealistic returns or pressuring you to share information is likely a fraudster. Vigilance is the strongest protection,” he said. During his inspection, the DGP also instructed officers to improve the condition of the police station’s waiting room, ensuring it is clean, orderly, and comfortable for complainants. In a post on X, Singh recounted his arrival at the cyber police station to file a case regarding digital arrest. “The gate sentry didn’t recognise me. When I said I needed to file a case, he directed me to the duty officer on the second floor in room number 24, who was busy with a complainant’s matter.” He also stressed the importance of maintaining proper uniform standards. While leaving the police station, Singh asked a gunman how many sets of uniforms he had and how frequently he ironed them. He even pointed out to an inspector that his cap was tilted to one side, he corrected it, and reminded him to maintain a smart appearance.Upon hearing about the top cop’s arrival at the police station, police commissioner Vikas Arora, DCP (east), and the district attorney made their way to Cyber East police station shortly thereafter. The top cop remained at the police station for over two hours.The DGP further said he had discussed with the police commissioner the issue of challan records not reaching Lok Adalats for extended periods. “I instructed the CP to address this. Also, I advised IG (cyber) to visit at least one cyber police station each week. Identify three key problems faced by cybercrime victims and work towards resolving them,” he added.
