JUMMU: The Jammu & Kashmir and Ladakh high court will hear the habeas corpus petition of detained Aam Aadmi Party (AAP) MLA Mehraj Malik on November 20.Malik, who is AAP’s Jammu & Kashmir unit president, was detained on Sept 8 under the stringent Public Safety Act for allegedly disturbing public order. Ever since, he has been lodged in Kathua jail. Malik filed the habeas corpus petition on Sept 24, challenging his detention and claiming Rs5 crore in compensation.Malik’s counsel submitted in court that the government failed to file its reply and because of its lackadaisical approach a sitting MLA has been behind bars. Govt’s counsel, on the other hand, submitted that the replies had been submitted but due to a defect in the affidavit, it was not on record.Malik’s petition was listed before Justice Rajneesh Oswal, a court source said.
