Rape survivor moves SC seeking cancellation of Asaram Bapu’s bail

MEERUT: The rape survivor, now 28, in the Asaram Bapu case has approached Supreme Court (SC) seeking the cancellation of the self-styled godman and rape convict’s bail granted earlier this year by the Rajasthan and Gujarat high courts on “medical grounds”. The matter is scheduled for hearing next on Dec 5.The petitioner’s counsel told the apex court that Asaram, 84, has been travelling across the country despite claiming ill health. He argued that Asaram’s conduct indicates that he is not seriously ill and has misused the relief granted by the courts.The counsel further pointed out that a medical board constituted by the Rajasthan HC in Aug reported Asaram’s health condition as “stable” and said he did not require hospitalisation. The lawyer also highlighted that Asaram has not undergone any long-term treatment in a hospital and is instead receiving Ayurvedic therapy in Jodhpur.On Oct 29, the Rajasthan HC granted Asaram six months’ bail on medical grounds, accepting arguments from his counsel that Asaram’s health required better medical attention outside prison. He contended that Asaram suffers from heart-related complications and deserves access to proper medical care. Citing the Rajasthan order, the Gujarat HC followed suit on Nov 6 and extended bail to him in another case pending there.Asaram has been lodged in Jodhpur Central Jail since Aug 2013 after being convicted of raping the then-16-year-old girl at his ashram near Jodhpur.The survivor’s father had said that they were living in constant fear. “Our lives have been turned upside down since my daughter’s ordeal. We live in constant fear, under the watch of Asaram’s followers. Suspicious vehicles trail our car whenever we step out…,” he added.In April 2018, a Jodhpur court sentenced him to life imprisonment, while his aides, Sharad and Shilpi, were awarded 20-year prison terms for their involvement. He was also convicted in a separate 2002 rape case and sentenced to 20 years. After nearly 12 years in jail, Asaram was first granted interim bail on medical grounds on Jan 7 this year, which was later extended in July and thereafter in Aug.
