Ahmedabad woman gets 2 years in jail for throwing baby from 9th floor; cleared of murder, convicts for hiding birth

AHMEDABAD: A sessions court in Gandhinagar on Friday convicted a 25-year-old woman to two years’ imprisonment for concealment of birth and disposal of a child’s body. This happened after she allegedly threw her newly born male child from the ninth floor. Murder charges against her could not be proved.In this case, the residents of Skywalk Society in the Chandkheda area found the dead body of a newly born male child on April 19, 2023, apparently thrown from a height. The apartments had 10-storey blocks. The police found that the child was thrown from a bathroom on the ninth floor. The accused woman was charged with murder and disposal of the child’s body under Sections 302 (murder) and 318 (concealment of birth by disposal of dead body) of Indian Penal Code.The prosecution examined 21 witnesses and presented various medical and scientific evidence to establish that the accused woman was the dead child’s mother. The identities of the mother and father were established. However, the prosecution could not establish that the accused woman killed the infant.After the trial, additional sessions judge P M Unadkat acquitted the woman of the murder charge and stated, “Considering the entire set of evidence, no proof has come on record showing that the accused committed this act with an intention to kill the newborn baby. Therefore, the ingredients of IPC Section 300 are not established.”The court held the woman guilty under Section 318 of the IPC and punished her with two years — the maximum punishment prescribed under this section. The accused has been behind bars since April 2023.
