MP HC judge recuses from mining case after BJP MLA's bid to contact him

BHOPAL/JABALPUR: Justice Vishal Mishra of the Madhya Pradesh high court Monday recused from a case of illegal mining, stating that BJP MLA from Vijayraghavgarh and former minister, Sanjay Pathak, who had tried to talk to him over phone regarding the case, was father of Yash Pathak and son of Nirmala Pathak – both directors of the mining company against whom action has been sought in the petition.Recusing himself from hearings, Justice Mishra directed that the petition be placed before Chief Justice Sanjeev Sachdeva for listing of the case before another bench.Ashutosh Dixit, a resident of Murwara in Katni town, in his petition had said that he had lodged a complaint with the economic offences wing (EOW) of MP police at Bhopal in Jan this year against Nirmala Minerals, accusing the company of illegal mining.The complaint said that the company has carried out illegal mining at Sehora town in Jabalpur, Gosalpur and Katni on a large scale and even the places earmarked as green belt have not been spared. Since there was no action by EOW on his complaint, he moved the court seeking action.During hearing of the petition, EOW apprised the court that Dixit’s complaint has been forwarded to MP mines and minerals department for action. The complaint is pending there.Directors of Nirmala Minerals, Nirmala Pathak and her grandson Yash Pathak, had moved an application in the court to join the proceedings as interveners. During hearing of the petition, Justice Vishal Mishra came to know that it was Yash Patha’s father Sanjay Pathak who had tried to talk to him over phone about the case.
