Firm told to pay stamp duty of Rs 21cr with penalty to cancel sale deed

PUNE: Officiating joint sub-registrar (class II), Haveli IV, A P Fulaware on Friday wrote to Amadea Enterprises LLP partner Digvijay Patil seeking payment of full stamp duty of Rs 21 crore along with penalty applicable as per law, before re-submitting a cancellation deed regarding the 40-acre Mundhwa land parcel deal. Deputy chief minister Ajit Pawar’s son, Parth, is the other partner in the firm.The joint sub registrar’s letter came after the company on Friday submitted a cancellation deed on the grounds that the data centre project it proposed to set up on the land has been scrapped.The May 20, 2025, sale deed executed between Sheetal Tejwani, the power of attorney (PoA)-holder of the land, and Patil for a consideration of Rs300 crore and registered with the Haveli IV sub-registrar’s office, had claimed stamp duty exemption under a state government notification dated Feb 1, 2024, which provided concessions for projects related to data centres and IT infrastructure.However, Amadea’s request to execute the cancellation deed nullifies the grounds on which the exemption was granted, a senior IGR official said. “If the purpose for which exemption was granted is cancelled, the full duty and penalty become payable,” the official said.As such, the letter to the firm makes it clear that it must pay the full stamp duty and penalty applicable under the law. “The firm has to pay the entire amount and the same has been conveyed to its partner,” the official said.The letter though did not specify the full stamp duty amount and penalty. It stated, “As per Condition No. 6 of the said govt notification, it is necessary to pay stamp duty and penalty at 5% plus 1% local institution tax plus 1% Metro tax totaling 7% as per Section 25(b)(i) of the Maharashtra Stamp Act.” The official pointed out that the 7% stamp duty on Rs300 crore works out to Rs21 crore.The registrar observed that only ₹500 in stamp duty had been paid on the cancellation deed applied for on Friday, making the document “not properly stamped.” The firm has been told to rectify the discrepancies, pay the correct duty and penalty, and re-submit the document, the official said.
